1. Introduction and Acceptance
These Terms of Service ("Terms") govern your access to and use of the Blueprint Marketplace platform, including the website, APIs, dashboards, designer canvas, and any related services (collectively, the "Platform").
By creating an account, browsing Blueprints, deploying stacks, or using any feature of the Platform, you agree to be bound by these Terms and all policies referenced herein, including our Privacy Policy and Acceptable Use Policy.
Your use of the Platform constitutes your acceptance of these Terms. We may update these Terms periodically; material changes will be communicated via email, in-app notification, or banner. Your continued use after an update constitutes acceptance.
2. Definitions & Eligibility
Definitions:
"Blueprint" — A packaged, deployable recipe that bundles infrastructure, applications, networking, policies, and cost models into a single, ready-to-run unit.
"App" — An installable service or component (container, VM service, or managed service) that runs on compute infrastructure and exposes a consistent configuration model.
"Platform" — The entire Blueprint Marketplace service, including the website, designer canvas, orchestrator, registry, dashboards, and APIs.
"Publisher" — An individual, company, or organization that creates and publishes Blueprints or Apps through the Platform.
"Workspace" — A logical organization container where teams manage deployments, governance policies, billing, and user access.
"Deployment" — An active, running instance of a Blueprint or App.
"Third-Party Services" — External cloud providers, hyperscalers, managed services, or SaaS tools integrated with or used by Blueprints.
Eligibility & Account Creation:
You must be at least 18 years old and have legal capacity to enter into a binding agreement. If using the Platform on behalf of an organization, you represent you have authority to bind that organization.
You are responsible for maintaining confidentiality of all credentials: login credentials, SSO tokens, MFA codes, API keys, and workspace invitations. You are liable for all activities under your account. Notify us immediately of any unauthorized access or security breaches.
3. Platform Use & Restrictions
Permitted Use
You may use the Platform to browse, search, configure, and deploy Blueprints; manage and scale deployments; monitor costs and compliance; and collaborate with team members within your workspace.
Prohibited Use
You must not: attempt unauthorized access; interfere with guardrails/policies; scrape the catalog; deploy illegal/malicious workloads; infringe IP rights; reverse-engineer; or compete using the Platform. Violations may result in immediate suspension.
4. Marketplace & Publishers
The Platform hosts operator and independent Publisher content under various licenses: Open Source, Free, Commercial, or BYOL. Publishers are solely responsible for content accuracy and security. When deploying Publisher content, you accept any additional terms presented (EULA, SLA, support) to the extent they do not conflict with these Terms. Publisher terms apply to specific content; these Terms govern Platform use.
5. Pricing & Billing
The Platform offers Free, Paid (monthly/annual), and usage-based tiers plus Publisherdefined fees. You authorize Platform to charge your payment method per your account settings. Fees exclude taxes unless stated. Refunds require requests within 30 days; the Platform may issue credits. Cancel anytime; deployments charge until deleted.
6. Cost Caps & Estimates
Cost estimates are predictions only, not guarantees. You remain responsible for monitoring actual usage. The Platform enforces soft (alert) or hard (throttle/pause) guardrails per your settings but is not liable for overage charges or usage spikes. Provider billing may differ from Platform estimates due to discounts, regional pricing, or commitment terms.
7. Data & Privacy
You retain full ownership of your data, subject to Platform rights to operate and secure the service. See our Privacy Policy for personal data handling and data subject rights. You are responsible for selecting data residency (EU-only/Global/US-only) and compliance profiles (GDPR/PCI-DSS/HIPAA) that meet your obligations. The Platform provides controls but does not provide legal advice. For EU residents, the Platform acts as a processor; a DPA is available and deemed accepted upon use. You have GDPR rights (access, deletion, portability) under Articles 15–21. Data transfers comply with GDPR Chapter V.
8. Third-Party Services
Blueprints deploy to hyperscalers (AWS, Azure, GCP) and managed services (databases, CDNs, SaaS tools) governed by their own terms, policies, and SLAs. The Platform does not own or control third-party services and is not liable for their availability, security, pricing, or compliance. You are responsible for reviewing and accepting third-party terms, maintaining credentials, monitoring billing, and escalating issues. You remain the account owner and liable for all usage and charges.
9. Intellectual Property & Content
Platform IP: The Platform's UI, orchestration engine, guardrails, algorithms, and content are protected by copyright/trademark/patent. All rights reserved.
Publisher IP: Publishers retain ownership and grant the Platform worldwide, nonexclusive licenses to host, display, and analyze their content.
Your Rights: You may view, deploy, and internally clone Blueprints per their licenses. You may not resell, redistribute, remove notices, or use content to compete.
Open Source: Some Blueprints include open-source components (MIT, Apache 2.0, GPL) whose terms supersede these Terms where applicable. License details appear in Blueprint pages and SBOM.
User Content
Reviews, feedback, discussions, support tickets, and configurations you submit grant the Platform worldwide, royalty-free, non-exclusive rights to host, display, and use your content for service improvement. You retain copyright and may request removal anytime (subject to backup/legal holds). Platform may use feedback without obligation.
10. Service, Warranties & Liability
Service Levels: Unless signed separately, service is best-effort without guaranteed uptime or performance. The Platform may modify or discontinue features with 30–90 days' notice (24 hours for critical changes). Scheduled maintenance may cause temporary unavailability.
Disclaimers: The Platform is AS-IS without warranties of merchantability, fitness, or noninfringement. No warranty that Blueprints will perform, deployments be stable, third-party services available, Publisher content bug-free, or cost estimates accurate. Use at your risk.
Liability Limit: No liability for indirect/consequential damages. Maximum liability = fees paid in prior 12 months; free users capped at $100. Applies to all liability theories (breach, tort, negligence). Some jurisdictions prohibit these limitations; liability limited to maximum extent permitted by law.
Indemnification: You indemnify the Platform for your use, deployments, violations, IP infringement, data breaches, or third-party claims. This applies regardless of Platform fault. Platform will notify you of claims, cooperate reasonably, and permit your defense.
Suspension/Termination: Platform may suspend/terminate for breach (uncured 30 days), non-payment (15+ days), security/compliance risk, AUP violation, harassment, legal prohibition, or emergencies (immediate). You may cancel anytime. Upon termination: access ceases, deployments may be deleted, you remain liable for charges, and you may export data within 30 days. Indemnification, liability limits, and IP survive indefinitely.
Confidentiality: Each party keeps confidential information confidential (trade secrets, pricing, customer lists, credentials). Exceptions: public information, independently developed, rightfully received from third parties, or legally required disclosure (with notice when permitted).
11. Governing Law & Disputes
These Terms are governed by law without regard to conflict principles. Exclusive jurisdiction: courts. EU consumers may bring claims in their country of residence. B2B disputes may use binding arbitration (ICC/LCIA) in under its rules; each party bears costs unless arbitrator awards otherwise.
12. General & Contact
Term Changes: The Platform updates these Terms for service changes, legal compliance, security, or clarification. Material changes require 30 days' notice (email/in-app/website) except emergencies. Continued use = acceptance. We won't auto-charge under materially adverse new terms.

Entire Agreement: These Terms + Privacy Policy + Acceptable Use Policy + DPA + any SLA = entire agreement and supersede prior agreements.
Severability: Invalid provisions will be severed to the minimum necessary to enforce; remaining provisions continue in full force.
